Terms of Service

These Terms govern access to and use of Zesto — the customer operations and AI-assisted support platform at zesto.dev and related services.

1. Agreement

By creating an account, accessing the Service, or clicking to accept these Terms, you agree to this agreement on behalf of yourself and, if applicable, the organization you represent (“Customer”). If you do not agree, do not use the Service.

If you use the Service for an organization, you represent that you have authority to bind that organization. “You” means the Customer and authorized users of a workspace.

2. The Service

Zesto provides software for customer support and operations, including helpdesk workflows, knowledge and public site surfaces, CRM-style contact context, integrations, and optional AI-assisted triage, drafting, and tools under workspace configuration.

Features may change as we improve the product. We may add, modify, or deprecate functionality with reasonable notice when a change materially reduces core paid capabilities.

3. Accounts and workspaces

You must provide accurate account information and keep credentials secure. You are responsible for activity under your accounts and workspaces, including invites and role assignments.

Workspace administrators control membership, integrations, secrets, and AI/tool policy for that workspace. Do not share credentials or secrets outside your organization's policies.

4. Customer data and content

“Customer Data” means data you or your end users submit to the Service (for example tickets, messages, knowledge, forms, contacts, and configuration). As between you and Zesto, you retain ownership of Customer Data.

You grant Zesto a limited license to host, process, transmit, and display Customer Data solely to provide and secure the Service, prevent abuse, and comply with law. We do not sell Customer Data.

You represent that you have the rights and notices required to submit Customer Data (including personal data of your customers) to the Service.

5. AI features

Optional AI features may draft replies, triage, summarize, or call tools you enable. Outputs can be wrong, incomplete, or inappropriate. You remain responsible for reviewing customer-facing content and for actions taken in your workspace.

High-risk actions (for example refunds or irreversible account changes) may require human approval under product policy. Factory defaults are designed so AI does not auto-send customer replies or execute refund-class tools without human control, unless you deliberately change those settings.

Model providers and your own keys (BYOK), when configured, may process prompts and context under their terms. See the Privacy Policy for how we handle data in AI paths.

6. Acceptable use

You may not:

  • Violate law, privacy rights, or intellectual property rights
  • Probe, scan, or attack the Service, or bypass access controls
  • Use the Service to send spam, malware, or abusive content
  • Resell or provide the Service to third parties except as allowed in a written agreement
  • Reverse engineer the Service except where law prohibits that restriction
  • Use AI features to generate unlawful content or to evade human review where policy requires it

We may suspend access for suspected abuse, security risk, or non-payment.

7. Third-party services

The Service may connect to third parties you configure (email providers, OAuth identity providers, model APIs, storage, and similar). Their terms and privacy policies apply to those services. Zesto is not responsible for third-party outages or policy changes outside our control.

8. Zesto intellectual property

Zesto and its licensors own the Service software, branding, documentation, and related IP. These Terms do not transfer ownership of that IP to you. Feedback you provide may be used to improve the Service without obligation to you.

9. Plans and billing

Some features may be free, trial, or paid. Paid plans, if offered, will state fees, renewals, and taxes at purchase. You authorize us (and our payment processors) to charge the payment method you provide for subscribed fees.

Unless required by law or stated otherwise at purchase, fees are non-refundable for partial periods after a billing cycle starts.

10. Availability and support

We aim for high availability but do not guarantee uninterrupted Service. Maintenance, force majeure, and dependency outages may affect access. Support channels and targets may vary by plan.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZESTO DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING. AI OUTPUTS ARE NOT LEGAL, MEDICAL, OR FINANCIAL ADVICE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZESTO AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, COVER, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.

OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO ZESTO FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF YOU HAVE PAID NOTHING).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

13. Indemnity

You will defend and indemnify Zesto against claims arising from Customer Data, your use of the Service in violation of these Terms or law, or your end users' use of public surfaces you operate on the platform, except to the extent caused by our willful misconduct.

14. Term and termination

These Terms apply while you use the Service. You may stop using the Service and request workspace closure subject to product tools and our retention practices. We may terminate or suspend for material breach, abuse, legal risk, or prolonged inactivity on free plans.

Provisions that by nature should survive (including ownership, disclaimers, liability limits, and indemnity) survive termination.

15. Changes to these Terms

We may update these Terms. Material changes will be posted on this page with an updated effective date, and we may notify account owners by email or in-product notice. Continued use after the effective date constitutes acceptance, except where law requires additional consent.

16. General

These Terms are the entire agreement for the Service unless superseded by a signed order or MSA. If a provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign to an affiliate or in connection with a corporate transaction.

Governing law and venue will be the laws and courts of the jurisdiction where the operator of Zesto is established, without regard to conflict-of-law rules, unless a signed agreement says otherwise. Consumers in some regions may have mandatory local rights that these Terms do not override.
